The scope and severity of the crimes committed here are mind boggling.  This is systemic corruption involving former FSPHP President Dr. Luis Sanchez and VP of laboratory operations Joseph jones.   I have heard of multiple suicides due to allegedly falsified positive PEth given just before the end of a monitoring contract. This appears to be common and some kill themselves rather than endure another five-years under PHS monitoring.

I have been providing evidence of forensic fraud to Deb Stoller since December of 2011. The litigation packet clearly shows collusion between Sanchez and Jones.  Due to the consequences of forensic drug testing any civil person would attempt to expose the forensic fraud but Stoller suppressed it and all of the other evidence that was difficult to obtain..  I wonder how many suicides have been the result of falsified PEth tests over the past five-years?    This is far worse than Annie Dookhan and USDTL is used by PHPs across the country not just Massachusetts and the consequences can be permanent.

Forensic testing needs to be as close to 100% specific as possible because the results of a positive test can be grave and far reaching.   Getting this test (and all the others) approved and marketed through a loophole and then getting the state Boards and Federation of State Medical Boards to approve them by moral entrepreneurship is unconscionable.    Using the LDT pathway is just another example of how the “impaired physician movement” removes accountability and culpability by bending, ignoring or otherwise making their own rules.And the labs have taken a “stand your ground” approach. Never admit wrongdoing. Never settle.In a February 2007 article in the magazine “New Scientist,” Dr. Skipper is quotedthat:“…there is not yet an agreed threshold concentration that can be used to separate people who have been drinking from those exposed to alcohol from other sources. Below 1000 nanograms of EtG per millilitre of urine is probably ‘innocent’, and above 5000 booze is almost certainly to blame. How is this any different from the case of Dr. Farid Fata, the Michigan oncologist who intentionally diagnosed healthy patients with cancer so he could charge them for unneeded chemotherapy?  The U.S. Attorney called it the “most egregious” case of health care fraud ever. His acts may have contributed to one patient death.   The institutional injustice of the PHP system is causing countless deaths of physicians.To consciously “tailor” a diagnosis is fraud.  To tailor a diagnosis of substance use disorder or any other psychiatric diagnosis is the political abuse of psychiatry.  Misrepresentation, dishonesty, deception, and distortion play no role in the Profession and Guild of Medicine.  To do so violates the basic moral principles of Medical Ethics–Autonomy, Beneficence, Non-Maleficence and Justice.

None of these deaths were investigated. None were covered in the mainstream media.   These are red flags that need to be acknowledged and addressed!    This anecdotal evidence suggests the oft-used estimate of 400 suicides per year (an entire medical school class) is a vast underestimation of reality—extrapolating just the five deaths above to the entire population of US doctors suggests we are losing at least an entire medical school per year.As physicians we need to demand transparency, oversight, regulation and auditing by outside groups. This is a public health emergency.

The coercion, control, ethics, and civil

The civil and human rights violations remain hidden. The crimes remain hidden. So too will this.

It appears the FSPHP is following the same pattern they have with the “impaired” and “disruptive” physicians–to discriminate. The targeting of gay, lesbian or transgender doctors for what they do in their private lives is predictable. It is an inevitable part of this well oiled slope of coercion, control, obedience and abuse.

The import of this can not be overestimated.

 In 1995 this was a simple but growing shakedown scheme using a medical license to extract money under the threat of its loss. The PHP refers doctor X to “PHP-approved facility” for an evaluation and the “PHP-approved” facility tells doctor X you will stay here until I say so or I tell the PHP you ain’t gettin your license back. Doctor X stays because he knows the PHP can do it as the PHP is not going to be questioned by the medical board.They refer to it as “contingency-management” but it essentially meets the criminal definition of extortion.

The reliability, validity and accuracy of drug test results needs to  be known prior to using a test.  Specificity and sensitivity must be known prior to using a test on any population.This should go without saying as to do anything else would be irresponsible and careless.
