There is no evidential standard used and false accusations and even forged documents are routinely used against the targeted doctor. Physicians are ill prepared for such criminal tactics used against them, by the time they realize it is happening, it is too late to stop the inevitable process that threatens their medical license. This is very emotionally traumatic to doctors who have always excelled in their schooling, worked hard to get where they are, and are facing the loss of not only their professional careers but also financial security, their self esteem and self concept.

I get many e-mails, letters and phone calls from doctors, nurses and others who have been abused by  “professional health programs” (PHPs).  Most do not want their letters published for fear of being identified and punished by the PHP.   They are reluctant to do so even with their names and states removed as they feel their complaints alone could reveal their identity to they prying eyes of the PHP.   A few have allowed their letters to be posted and I am doing so here:    Letters From Those Abused and Afraid

As the Medical Review Officer (MRO)  for the Massachusetts state Physician Health Program (PHP), Physician Health Services, Inc. (PHS, inc.), Dr. Wayne Gavryck’s responsibility is simple.  He is supposed to verify that the chain-of-custody  in any and all drug and alcohol testing is intact before reporting a test as positive.

Class Action Suit Filed Against Michigan PHP Alleging Constitutional Violations Related to Involuntary Treatment—Looking for Attorneys Familiar with (or Willing to Learn About) PHP Issues to File Similar Suits Including here in Massachusetts

The issues are the same and include:

1. False assessments and diagnoses.
2. Forensic fraud and falsified drug and alcohol tests.
3. Collusion with third party commercial labs to commit fraud.
4. Establishment clause violations.
5. HIPAA Violations.
6. Anti-trust violations.
7. Ultra vires acts as non-profit agencies including the unlawful practice of medicine.

Please click on the links above to see detailed examples and discussions of these issues.  It is an open area as my survey has revealed an additional factor stacking the deck and removing accountability from PHPs.

The attorneys ostensibly representing doctors are also part of the racket.

A doctor referred to a PHP will be given a list of 3 or 4 attorneys by the PHP who are “experienced in working with the medical board.” What they do not tell you is that theses attorneys are hand-picked or cultivated to abide by the rules dictated by the PHP.

They will not “bite the hand that feeds” and any procedural, ethical or criminal misconduct by the PHP will not be addressed.

My survey also indicates some states are worse than others and North Carolina, Washington, Florida and Massachusetts are over-represented as far as misconduct and ethical violations.

Screen Shot 2015-01-09 at 1.59.40 AMA Federal class action lawsuit has been filed in the Eastern District of Michigan against the state PHP program alleging constitutional violations related to the forced medical treatment of health care professionals involved in the State’s  “Professionals Health Program” (PHP)  and the “callous and reckless termination of professional licenses without due process.”  According to the complaint:

“The Health Professional Recovery Program (HPRP) was established by the Michigan Legislature as a confidential, non-disciplinary approach to support recovery from substance use or mental health disorders. The program was designed to encourage impaired health professionals to seek a recovery program before their impairment harms a patient or damages their careers through disciplinary action. Unfortunately, a once well-meaning program, HPRP, has turned into a highly punitive and involuntary program where health professionals are forced into extensive and unnecessary substance abuse/dependence treatment under the threat of the arbitrary application of pre-hearing deprivations (Summary Suspension) by LARA.filed…

It is only a few public policy steps and minor changes in state regulatory statutes before what is described in the ASAM White Paper on Drug Testing comes to fruition.  Before we know it the Drug and Alcohol Testing Industries “New Paradigm” as described here by Robert Dupont will be ushered in.  From the ASAM white Paper:

Policy and Regulatory Decision Making in the Medical Profession: A Framework to Identify the influence of Special Interest Groups and “Bent” Science

Presently every paper dating back to 1967 is available online and the availability of full articles published sequentially over the past half-century is historically invaluable. As the official journal of the national organization involved in the medical licensing and regulation of doctors, this archival organization allows for an unskewed and impartial examination in both historical and cultural context. We can identify when particular issues and problems were presented, who presented them and how.

While the episode takes place in 1970 and there has since been a gradual shift to a more patient-centered approach in medicine, it offers a glimpse into power imbalances in medical care that still can occur today.

This non-fictional work revolves around the theme of scientists reporting facts and being persecuted for it by religious authorities, other scientists, activists, and organizations who feel threatened by the truth or who have a vested interest in the perpetuation of non-truth.  The book starts off with Galileo and his cohorts, such as Versalius, Copernicus, and Bruno (burned at the stake for heresy) who challenged the dogma of the Catholic church with ideas born of keen observation and logical reasoning thus making new discoveries and ushering in the beginning of the scientific revolution.  Galileo’s middle finger, which he once pointed up at the heavens, is now mummified and on display in the Uffizi museum in Florence, Italy. Irrational authority and the 21st Century Witch-Prickers

It is imperative the greater medical community be awakened to the actual nature of the ASAM FSPHP state physician health program agenda and apprehend the true significance of this spirituality based nanny statism. Unfortunately it may be too late as it is. Strange days have tracked us down.

The New York City Medical Society on Alcoholism  was started in the 1950s by Dr. Ruth Fox to promote AA and 12-step to doctors. This organization subsequently became the American Medical Society on Alcoholism (AMSA) and eventually the American Society of Addiction Medicine (ASAM).  Like the National Council on Alcoholism and Drug Dependence (NCADD), an organization that promotes the A.A. yet claims to have no formal ties, the ASAM is considered by many to be a front-group that purports to represent one agenda while in reality serving other interests. The ASAM can be considered both a political (prohibition, 12-step spiritual recovery) and corporate (inpatient rehabilitation facilities, drug testing industry) front group in this regard.
