“To be sure, and to put this matter to rest for the Court once and for all, the Board has retrieved from off site storage those materials before the Board in December 2011. The documents that Dr. Langan claims were “suppressed” are in fact there—and this should not be surprising given the Board’s many orders since that time, all of which have disclaimed any reliance on the July 2011 PEth test.”

  1. Wish I wasn’t so far away but will watch on video.*** Wonder how this new AAG likes defending the actions of D. Stoller? Any of them who say ” i was just doing my job.” is one sick puppy.
    You have a good case , if the judge is not biased and looks at the legal and evidence you should prevail.
    They do not like to admit they were wrong or any wrongdoings ! Thanks for doing the fight for all of us !

    • Bertram’s the sole AGO assigned to the case and bamboozled the single justice for almost two years into not looking at the evidence -but this is before the full bench of the MA Supreme Judicial Court ( 7 Justices) – his case has so many holes you could drive a truck through it,

  2. only able to get the states ending argument, my speakers broke and lib opened 0800am my time 11 yours. Bertrams did NOT answer the questions ! skirted around . The woman judge held him to it.
    She “got it ” no patient involved. The question was how did the medical bd get involved, he rambled on about positives and chain of custody compromised. When he got done she asked again.
    They also wondered about this catch 22 , put you out of work but expect you to pay . I will try to get the video . And his response, “he can always contact the board” . YEA RIGHT !!! everything you say or do is held against you , yes you can contact but when they are hard headed with the taxpayers money whats the point . They have never admitted this made a mistake ! And wont !
